At the time relevant here, Code of Civil Procedure section 664.6 (hereafter section 664.6) provided: "If parties to pending litigation stipulate, in writing or orally before the court, for settlement of the case, or part thereof, the court, upon motion, may enter judgment pursuant to the terms of the settlement." (Italics added.)*fn1 In this case we address an issue on which the Courts of Appeal have issued conflicting decisions: whether the written stipulation must be signed personally by the litigant, or whether the signature of the litigant's attorney is sufficient to create a settlement enforceable under section 664.6. We conclude that section 664.6 requires the signature of the litigant.
